Terms of Service

Please read these Terms carefully. By creating an account, purchasing a plan, or using StepExamPrep.com, you agree to be bound by them. If you do not agree, do not use the Service.

1. Who we are

StepExamPrep.com (the “Service,” “we,” “us,” or “our”) is operated by ASFMS, an LLC organized under the laws of Florida/United States. Questions about these Terms can be sent to support@stepexamprep.com.

2. Not affiliated with the USMLE, NBME, or FSMB

StepExamPrep.com is an independent study resource. We are not affiliated with, endorsed by, or sponsored by the National Board of Medical Examiners (NBME), the Federation of State Medical Boards (FSMB), or the United States Medical Licensing Examination (USMLE) program. USMLE® is a registered trademark of the NBME and FSMB. Any reference to the USMLE or Step 1 is for descriptive purposes only.

All questions on the Service are original works written by our authors. They are not actual, retired, or leaked USMLE questions. The format of our practice exams is modeled on the publicly described structure of Step 1 so that you can rehearse pacing and stamina, but our content is not the content of any real examination.

3. Eligibility and accounts

  • You must be at least 18 years old to create an account.
  • You must provide accurate registration information and keep it up to date.
  • You are responsible for keeping your login credentials confidential and for all activity under your account.
  • Accounts are personal. You may not share your login with others or allow anyone else to use your account.
  • Notify us promptly at support@stepexamprep.com if you believe your account has been compromised.

4. Purchases, subscriptions, and refunds

Certain features, including access to full-length practice exams, require a paid plan. Prices are shown at checkout and are stated in U.S. dollars unless otherwise indicated. Payments are processed by a third-party payment processor Stripe; we do not store your full card details.

  • Access period. Your plan grants access for the period stated at purchase. Access ends automatically at the end of that period unless you renew.
  • Auto-renewal. Subscriptions renew automatically at the then-current price until cancelled. You may cancel at any time from your account settings; cancellation takes effect at the end of the current billing period.
  • Refunds. We offer a full refund within 7 days of purchase provided you have not started a full-length exam block. Refund requests should be sent to support@stepexamprep.com.
  • Price changes. We may change prices for future purchases or renewals. We will notify you in advance of any change to a recurring price.
  • Taxes. You are responsible for any applicable sales, use, or value-added taxes.

5. License to use the Service

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to access the Service and view its content for your own individual exam preparation. This license does not permit any commercial use.

6. Our intellectual property

All questions, answer explanations, images we have created or arranged, software, design, logos, and other content on the Service (collectively, “Content”) are owned by us or our licensors and are protected by copyright, trademark, and other intellectual property laws. Except as expressly allowed in these Terms, you may not:

  • copy, reproduce, download, screenshot, photograph, transcribe, or otherwise record any question, explanation, or image;
  • distribute, publish, sell, sublicense, or share Content with any third party, including in study groups, forums, messaging apps, or file-sharing services;
  • use Content to create a competing product, question bank, or training dataset for any machine-learning system;
  • scrape, crawl, or use automated tools or scripts to access the Service or extract Content;
  • circumvent, disable, or interfere with any security or access-control features;
  • remove any copyright, trademark, or proprietary notices.

Some clinical images on the Service are sourced from the U.S. Centers for Disease Control and Prevention Public Health Image Library (CDC PHIL) and are in the public domain. Our selection, arrangement, and accompanying question text remain our proprietary Content.

7. Acceptable use

In addition to the restrictions above, you agree not to:

  • use the Service in any way that violates applicable law or the rules of any examination body;
  • attempt to gain unauthorized access to other accounts, our servers, or our databases;
  • upload malicious code or take any action that imposes an unreasonable load on our infrastructure;
  • impersonate another person or misrepresent your affiliation with any person or organization;
  • resell, rent, or lease access to the Service.

8. Educational purpose only; no guarantee of results

The Service is intended to help you practice for a standardized examination. We make no representation or warranty that use of the Service will result in any particular score, a passing result, or admission to any program. Practice scores and analytics shown on your dashboard are estimates based on your performance on our material and are not predictions of your actual USMLE performance.

Nothing on the Service constitutes medical advice, diagnosis, or treatment. Clinical vignettes are hypothetical and written for educational purposes. Do not rely on any Content to make decisions about the care of real patients.

9. Accuracy and updates to content

We work to keep our questions and explanations accurate and aligned with current medical knowledge, but medicine evolves and errors can occur. We may revise, replace, or retire questions at any time. When a question is updated, exams you have already started or completed will continue to reflect the version that was live when you began that attempt, so that your results remain consistent. If you believe a question contains an error, please report it to support@stepexamprep.com.

10. Availability and changes to the Service

We aim to keep the Service available at all times but do not guarantee uninterrupted access. We may perform maintenance, release updates, or modify or discontinue features with or without notice. We will use reasonable efforts to preserve your saved progress and results during updates, but we are not liable for any loss of data that results from events outside our reasonable control.

11. Privacy

Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.

12. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your account, with or without notice, if we reasonably believe you have violated these Terms, particularly the intellectual-property and account-sharing provisions. Termination for violation does not entitle you to a refund. Sections 6, 8, 13, 14, 15, and 16 survive termination.

13. Disclaimer of warranties

THE SERVICE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE OR THAT DEFECTS WILL BE CORRECTED. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

14. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE AND OUR OWNERS, AUTHORS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR OPPORTUNITY (INCLUDING EXAM OUTCOMES), ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

15. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your violation of these Terms or your misuse of the Service or Content.

16. Governing law and disputes

These Terms are governed by the laws of Florida, without regard to conflict-of-law principles. Any dispute arising out of these Terms or the Service will be resolved exclusively in the state or federal courts located in Miami-Dade County, Florida, and you consent to the personal jurisdiction of those courts.

17. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date above and, where appropriate, notify you by email or through the Service. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

18. General

  • These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Service.
  • If any provision is found unenforceable, the remaining provisions remain in effect.
  • Our failure to enforce any right is not a waiver of that right.
  • You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
